ORDINANCE NO. 1412

AN ORDINANCE PROVIDING FOR THE ANNEXATION OF “Big Horn Cooperative Marketing Association, Wyoming nonprofit corporation”

TO THE TOWN OF THE CITY OF BUFFALO, WYOMING.

NOW, THEREFORE, be it ordained by the governing body of the Town of the City of Buffalo, Wyoming, as follows:

SECTION ONE: That the following described lands located in Johnson County, Wyoming, be annexed to the corporate limits of the City of Buffalo, and shall be known as the “Big Horn Co-Op” to the Town of the City of Buffalo, Wyoming:

Township 51 North, Range 82 West, 6th P.M., Johnson County, Wyoming

Section 36: A tract of land located in the Northwest Quarter of the Northwest Quarter (NW¼NW¼), Section 36, Township 51 North, Range 82 West of the Sixth Principal Meridian, Johnson County, Wyoming, more particularly described as follows:

Beginning at a point N89°47W, 77.3 feet along the South right of way line of US Highway 16, to the West line of said Section 36 and N00°21’W, 30.0 feet to the Northwest corner of said Section 36, said point being on the South right of way of US Highway 16; thence South 415.0 feet; thence S89°47’ E, 1260.0 feet to the East line of the NW¼NW¼, said Section 36,thence North along the East line of the NW¼NW¼, said section 36, 415.0 feet to a point on the South right of way line of US Highway 16 and 30.0 feet South of the West 1/16 corner of said Section 36; thence N89°47’W, 1260.0 feet along the South right of way line of US Highway 16 to the point of beginning.

SECTION TWO: That the annexation of the area would constitute a natural geological, economical, and social part of the Town of the City of Buffalo, Wyoming. The area to be annexed is a logical and feasible addition to the Town of the City of Buffalo, Wyoming, and the extension of basic services, such as water and sewer systems, solid waste collection, street lighting, road maintenance, police and fire protection, and other services customarily available to the residents of the City can reasonably be furnished to the area to be annexed, and that the area to be annexed is contiguous with or adjacent to the Town of the City of Buffalo, Wyoming.

SECTION THREE: That all the owners of the property to be annexed have joined in the petition for annexation.

SECTION FOUR: That the property to be annexed shall be annexed and a plat thereof approved.

SECTION FIVE: That the property to be annexed shall be zoned “I-1” Industrial

SECTION SIX: The annexation of the lands described herein shall constitute a conveyance of any water rights appurtenant to said lands and the landowners have consented to a change of use of any water and water rights applicable to the lands within the Subdivision from agriculture to municipal, at the discretion of the City.

SECTION SEVEN: This ordinance shall become effective upon its passage and publication in accordance with law.

PASSED, APPROVED AND ADOPTED BY THE GOVERNING BODY OF THE TOWN OF THE CITY OF BUFFALO, WYOMING, THIS DAY OF, 2022.
