AN ORDINANCE AMENDING ARTICLE 3: PROCEDURES, AMENDMENTS & CHANGES, SECTION 7, ANNEXATION OF TERRITORY, SUBSECTION D, OF THE CODE OF THE CITY OF BUFFALO, WYOMING, PERTAINING TO THE CLASSIFICATION OF TERRITORIAL ADDITIONS TO THE INCORPORATED AREA OF THE CITY OF BUFFALO RESULTING FROM ANNEXATION.

WHEREAS, the City finds it necessary to amend ARTICLE 3: PROCEDURES, AMENDMENTS & CHANGES, Section 7, Annexation of Territory, Subsection D, of the Code of the Town of the City of Buffalo that refers to the classification of territorial additions to the incorporated area of the City of Buffalo resulting from annexation.

NOW, THEREFORE, be it ordained by the governing body of the Town of the City of Buffalo, Wyoming as follows:

SECTION ONE:  ARTICLE 3: PROCEDURES, AMENDMENTS & CHANGES, Section 7, Annexation of Territory, Subsection D, currently provides:

Section 7. Annexation of Territory

D. Any territorial additions to the incorporated area of the City of Buffalo resulting from annexation shall be classified and regulated as an R-1 Low density Residential District. All uses in existence prior to being annexed and incorporated into the City which are not permitted in the R-1 District shall be deemed as legal non-conforming uses, thereby limiting the extent of the property’s use until the property is rezoned into conformance with this ordinance, after incorporation into the City limits.

SECTION TWO:  ARTICLE 3: PROCEDURES, AMENDMENTS & CHANGES, Section 7, Annexation of Territory, Subsection D, of the Code of the City of Buffalo is hereby amended to read, in its entirety, as follows:

Section 7. Annexation of Territory

D. Undeveloped territorial additions to the incorporated area of the City of Buffalo resulting from annexation shall be initially classified and regulated as an R-1 Low density Residential District. Uses in existence prior to being annexed and incorporated into the City which are not permitted in the R-1 District shall be deemed as legal non-conforming uses, thereby limiting the extent of the property’s use until the property is rezoned into conformance with this ordinance, after incorporation into the City limits. The City of Buffalo Planning Commission shall make a recommendation to the City Council for the zoning designation for the developed additions to the incorporated area of the City of Buffalo. The Planning Commission may consider historical use, current use, landowner input, and other factors deemed relevant by the Planning Commission in reaching its recommendation.  The City Council shall classify the zoning designation at the time the annexation is approved.

SECTION THREE:  This ordinance shall become effective upon its passage and publication in accordance with law.
